Respected Sir, The flat owners whose flats were illegally trespassed by the trespassers & gundas approached to this office for seeking guidance to safeguard their property & to get justice. These flats were situated in the building constructed by M/s. Aman Enterprises. Date: 21.10.2023 The builder M/s. Aman Enterprises Proprictor Shri Manojkumar Narayan Singh, Shop No.02, Gayatri Archana, Plot No. 136, Sector 44, Seawoods, Nerul, Navi Mumbai entered into agreement for sale for housing project on 26.11.2014 with 4 family members who have equa rights (1) Janabai Ramdas Tandel, (2) Shri Ravindra Ramchandra Thakur 3) Shri Shakuntalc Ramchandra Thakur (4) Shri Arjun Jagannath Thakur in the area land situated at 397,74 sq.mtrs. Sector-16, Ulwe, Taluka – Raigad, District – Panvel (herein after referred to as “The Said Plo “) under Goathan Expansion Scheme 12.5% PAP (project affected persons scheme) by the CIDCO.On 26th August 2016 CIDCO has transferred this plot in the name of all 4 original allottees (farmers)as mentioned above vide document serial No.7607/2016 at PVL-2, Receipt No. 10243, dated 04.10.2016 (enclosed herewith). #R27/10/2023The original licensee transferred & assigned the lease hold rights, titles & interests of thesaid plot to M/s. Aman Enterprises through Manojkumar Ramnarayan Singh by Tripartite agreement dated 10.11.2016 executed between 1. The CIDCO Ltd., 2) original 4 licensee & 3) purchaser Aman Enterprises through Manojkumar Ramnarayan Singh duly registered with document serial No.9704/2016 at PVL-4, dated 10.11.2016 (enclosed herewith). That the Purchaser Aman Enterprises through Shri M.R. Singh (builder) paid above market value (enclosed herewith) of Rs.73,58,190/- to paid amount to all above 4 original allottees (PAP Farmers).after obtaining absolute title rights of above mentioned plot, builder constructedresidential-cum-commercial building on above plot with all legal valid permissions. No. ofresidential units 24 nos. & commercial units-5 nas were built by the builder Aman Enterprises on this plot.After completion of all flats the builder has sold 23 flats & 5 shops were also sold to thepurchasers.Suddenly the farmers by name Shri Ravindra Ramchandra Thakur & Shri Vijay Arjun Thakor & others filed a criminal case vide FIR No.0182/23 dated 5.9.2023 at Nhawa Sheva Police station Navi Mumbai under section 420 (enclosed herewith) on baseless, false & fabricated grounds.”Shri Ravindra Ramchandra Thakur is equal share holder 4/1 but this Shri RavindraRamchandra Thakur received too much amount out of purchase cost (Rs.73,58,190/-) of the saidplot Rs.38 lakhs. It means Shri Ravindra Ramchandra Thakur swallowed approximately doubleshare of purchase cost from the builder Shri M.R. Singh.Original allonces were total 4 have equal share of above mentioned plot.Over all cost of plot was Rs.73.58,190- divided by 4 each share holder have right toreceived Rs.18,40,000/- approx. But the said Shri Ravindra Ramchandra Thakur demandedcaorbitant amount Le double amount of his original share from Builder. This Shri RavindraRamchandra Thakur also seized share of other original allottees/ farmers fraudulently. In order to senle his own complications, he started threatening to the builder Shri M.R. Singh. This Sari Ravindra Ramchandra Thakur with the help of his gundas forcibly trespassed at No. 104, 105, 106, 304, 401, 402, 404&406 he put his own lock by breading original lock of real fat owners. While trespassing the above flats, the trespassers & gundas broke the lock & zebionkey & valuable goods were looted by the trespassers & criminals. And flat no. 105, 404, 304, 104 the said Shri Ravindra Ramchandra Thakur rent out to some unauthorised persons illegally. In fact the above all flats already sold by the builder to the customers. Shri Ravindra Ramchandra Thakur has no right over these flats & no any right to enter in this property. There is past history of antecedents in respect of the main conspirator Shri Ravindra Ramchandra Thakur prior to sell out the plot to builder Shri M.R. Singh of Aman Enterprises as follows:
